On November 30, 2005 the Canada Border Services Agency (CBSA) released a paper advising that importers and exporters should take steps to determine their exposure to AMPS assessments and document that such a review has been undertaken. The CBSA tips sheet is available at the following link:

An important step that is missing in the CBSA compliance check list is the determination whether there is “reason to believe” and if so what is the date of reason to believe that procedures, reports to CBSA were in error. It is the establishment of a reason to believe that leads to AMPS assessments not simply that there are errors in the customs reporting. It is also the existence of a reason to believe that requires importers/exporters to amend Customs transactions retroactively to the date when one had reason to believe or should have had reason to believe.

CBSA makes it very clear in its first checklist item that recognized professionals should be engaged to prepare a “report card” on the practices and procedures used by the importers and exporters. This checklist report card will be a large determinant in being able to access continued expedited release privileges in the coming months.

We will conduct a review of the linkages and systems used to capture information and properly report to CBSA. We will then determine if the systems are being used. Finally we will determine if there is “reason to believe” something is amiss and recommend corrective action where necessary. Our final report will include a full analysis of systems positives and shortcomings as well as areas where there is no reason to believe but changes should be considered.
